Once a person has asserted a 4th Amendment right, such as the right to counsel, after receiving a Miranda Warning, interrogation is ceased. In most cases, in order to resume interrogation, the suspect must be re-read their Miranda rights. However, if a person in custody initiates the resumption, officers do not need to repeat the Miranda Warning.
