Cannot Appeal a Motion for Summary Judgment

Missouri courts have stated that a court’s decision regarding a motion for summary judgment, whether it is denied or approved, is not appealable.  Since they are not appealable, it is important to respond to a motion for summary judgment as best as possible in order to protect yourself.

When served with a Missouri lawsuit and you receive a motion for summary judgment, you must show that that there are disputed material facts that the court must decide upon.  If you do not respond to the motion for summary judgment, you can be deemed to agree with the other side and therefore lose your case.

On appeal from summary judgment, rule requires “specific page references to the relevant portion of the record on appeal, i.e., legal file, transcript, or exhibits” that established the material facts. “[N]or can we determine which material facts, if any, pled by [such movements] were properly denied by [appellant’s] response[s].”
