Missouri Tax Sales

Small Employer Health Credit

The 2010 Affordable Care Act allows small businesses with less than twenty-five (25) full time employees with an average annual income of less than $51,600 to claim a tax credit for up to fifty percent (50%) of the employer’s contribution to the health insurance premiums.  This credit is the government’s way of incentivizing small business owners to pay for health insurance for their employees.

Transfers of Distressed Commercial Properties

There are four main ways a borrower can return a commercial property back to its lender when the borrower can no longer pay for the loan:

  1. Foreclosure – This is when the lender sells the property at the courthouse steps to the highest cash bidder.
  2. Trustee’s Sale – Similar to a foreclosure sale, this is when a lender sells the property by a public or private sale with a guaranty from a title company.
  3. Receivership – The lender hires an attorney or accountant to take over the commercial property and manage it for the lender and the borrower.
  4. Deed-in-Lieu-of-Foreclosure – This is when the borrower deeds the property back to the lender so the lender does not have to foreclose on the property.

Undistributed Money Switching from a Chapter 13 Bankruptcy to a Chapter 7 Bankruptcy

While this scenario does not involve many people, when it does apply to you, it is a very important rule.  In a Chapter 13 bankruptcy, a person makes monthly payments to the bankruptcy court in order to pay for the person’s creditors.  When the person is unable to make the monthly payments, the person can change their bankruptcy from a Chapter 13 bankruptcy to a Chapter 7 bankruptcy.  The funds that the court received before the conversion to a Chapter 7 that were not distributed to creditors are required to be returned to the debtor.

Missouri Use Tax

Missouri applies a use tax on any item that is purchased outside of Missouri but comes to rest in Missouri and is put to use in Missouri for even an instant by the purchaser.  However, if the purchaser never uses the item in Missouri, then no use tax is owed in Missouri.
