Wendy’s and Pizza Hut Raise Concerns Over NPC Bankruptcy Sale

Wendy’s Co. and Pizza Hut LLC are raising concerns over their largest franchisee’s efforts to sell its assets in bankruptcy court. NPC International operates 392 Wendy’s and 1,200 Pizza Huts across the country filed Chapter 11 bankruptcy on July 1, 2020 with a plan to sell its assets. The franchise agreements are its most valuable assets it is attempting to sell. Both Wendy’s and Pizza Hut have warned in filings in the U.S. Bankruptcy Court in Houston that they are uncomfortable about the sales of the franchise pacts to third parties. All bids are due on October 20, 2020 and November 5, 2020.

Federal benefit recipients with children have more time to the $500 Stimulus Payment

The IRS has reopened the registration period for individuals who receive Social Security, Supplemental Security Income, Railroad Retirement or veteran’s benefits, but didn’t receive $500 per child earlier this year when they received their own stimulus payment.

Federal benefit recipients can use the non-filers tool on the IRS website to get a catch-up payment for a qualifying child if they have NOT done so.

The non-filers tool is available on IRS website in both English and Spanish. This tool is available until September 30, 2020. The payment will be issued sometime in October.

Anyone who misses the September 30 deadline will need to wait until next year and claim the payment as a credit on their 2020 federal income tax return.

Dave and Buster’s Warns of Bankruptcy

The prognosis for Dave and Buster’s Entertainment looks increasingly dire as the coronavirus economy takes a massive bite out of revenue and the company looks to layoff hundreds of workers. The company warned that it may need to file for bankruptcy if it can’t reach an agreement with its lenders. Dave and Buster’s second-quarter revenue plummeted 85 percent this year compared to last year. The chain also plans to layoff 1,300 employees over seven states. The company has reached a temporary debt-relief deal until November 1, however if that deal isn’t extended the company may need to file for bankruptcy.

Ex-Owner in $146 Million Elder Care Default is Charged in Ponzi Case

A Chicago-area rabbi, who formerly owned a nursing home chain at the heart of the biggest default in the history of a federal mortgage-guarantee program, has been indicted on federal charges of stealing millions of dollars from investors. The $146 million default in 2018 was the worst ever for the program that insures mortgages on nearly 15 percent of the nations nursing homes. The default caused the Department of Housing and Urban Development to tighten some of its underwriting and review processes.

Judge Approves Plan to Sell Briggs & Stratton

Briggs & Stratton’s unsecured creditors will receive 7 to 10 cents on the dollar depending on when the company completes its bankruptcy court-approved sale to KPS Capital Partners. The final amount will depend on how quickly Briggs can complete its sale to the New York City private equity firm. The sooner it is completed, the more money the unsecured creditors will receive. The sale should be completed the week of September 21 according to the attorney for Briggs and Stratton.

U.S. Details Up to $14 Billion in New Aid for Farmers

The U.S. Agriculture Department released the details of a second round of COVID-19 aid for farmers, which will pay up to $14 billion to growers of corn, soybeans, wheat, livestock and tobacco as well as dairy. The aid follows the previous $19 billion relief program that assisted farmers in April. Less than $10 billion dollars of that relief has been paid out to date. The new package will be funded by the Commodity Credit Corp, a Depression-era program created to support farmers and would not need approval from Congress. The USDA also said that up to $100 million in aid for tobacco farmers will come from the CARES act.

Settlement Cancels $330 Million is Private Loans to ITT Students

An agreement involving a federal regulator and attorney generals from 47 states came to the agreement that covered debts of tens of thousands of former students of ITT Technical Institute. Those covered incurred the debt through ITT’s Peak loan program which was often used for students who had maxed out their federal student loans.

The settlement, which requires a federal judge’s approval, covers about 35,000 borrowers whom were left with high amounts of debts, ruined credit, and often times useless degrees. The agreement requires the loans to be cancelled and all collection efforts to cease.

Guidance Issued to Implement Presidential Memorandum Deferring Employee Social Security Tax Withholding

The Department of Treasury and the Internal Revenue Service issued guidance on implementing the Presidential Memorandum allowing employers to defer withholding and payment of the employee’s portion of the Social Security taxes if the employee’s wages were below a certain amount. Notice 2020-65 is posted on IRS.gov makes relief available for employers for some wages paid between September 1, 2020 and December 31, 2020.

Feds Make Another Arrest Amid Allegations of More Than $1 Billion in Bad PPP Loans

The feds made another arrest in connection with Paycheck Protection Program loan fraud. Attorney Jae H Choi of Fort Lee, N.J. has been accused of obtaining close to $9 million in PPP loans under fraudulent circumstances. Choi has been charged with three counts of bank fraud and one count of money laundering, according to the complaint.

A report by the House Select Subcommittee on the Coronavirus Crisis said that over $1 billion in COVID-19 relief went to companies despite being in violation of the program’s rules. 10,856 loans appeared to be multiple loans to the same recipient.
