Things Taxpayers Should Know About Claiming Dependents

Taxpayers should remember that personal exemptions are suspended for 2018. Taxpayers cannot claim a personal exemption for anyone of their tax return. This means that an exemption can no longer be claimed for a tax filer, spouse or dependents.

Here is what you should know about claiming dependents on your 2018 tax return:

  • A dependent is either a child or a qualifying relative who meets a set of tests. Taxpayers should remember to list the name and Social Security number for each dependent on their tax return.
  • Dependents cannot claim dependents
  • Dependents may have to file a tax return. This depends on certain factors like total income, whether they’ve married and if they owe certain taxes.
  • Taxpayers may be able to claim this credit for each qualifying child under age 17 at the end of the year, if the taxpayer claimed that child as a dependent.
  • Taxpayers may be able to claim credit for other dependents for qualifying relatives and children who don’t qualify for the Child Tax Credit.

Possession, Not Ownership, Determines Trespassing

A Missouri couple brought an action for trespassing under a statute that provides for triple damages for the removal of timber. The petition alleged that the couple owned property, from which others removed timber with the permission of a third party, who possessed the property under a contract for deed. On a motion for judgment on the pleadings, the circuit court assumes that those facts are true, and those facts show that the couple had no standing to bring the statutory action for trespass. That is because the statute, like a common law action for trespass, protects possession, not ownership.

Francesca’s Closes Stores as Sales Drop

Women’s retailer Francesca’s is closing outlets and cutting costs. The company reported three-month results that show that downward trends in sales and profits continue. As of May 4th, Francesca’s operated 722 stores. That is down from the 738 stores operated in 2018. The company has plans to close 30 or more stores this year.

Cosmetics Maker Coty Inc. to Restructure Operations

Beauty giant Coty Inc. is taking a $3 billion write down on brands they have acquired over the past couple of years, including CoverGirl and Max Factor. The company has struggled with weak sales and an executive turnover. Coty Inc. will restructure its operations and cut jobs soon.

Former California Financial Advisor Indicted in $14.5 Million Real Estate Fraud Scheme

Former California financial advisor, Paul Ricky Mata, was arrested and charged with running a $14.5 million real estate fraud scheme by tricking victims to invest in his businesses and then using their money for his personal expenses. He is charged with mail fraud, wire fraud, making false statements in a bankruptcy proceeding, and other offenses. If he is convicted on all counts, he would face a maximum sentence of 295 years in prison.

Education Secretary Betsy DeVos Sued By Student Loan Borrowers for Failing to Cancel Their Debt

More than 150,000 former students of for-profit colleges claim they were defrauded and have filed lawsuits against the U.S Department of Education and Education Secretary Betsy DeVos. The Department of Education, under DeVos, has been accused of the failure to implement a regulation known as borrower defense which allows students to have their federal student loans cancelled if their school misled them or engaged in other misconduct. Over 150,000 people have filed claims with the government that their school defrauded them and new applications continue to be made.
