Non-Compete Breaches Can Survive Bankruptcy

In a recent court case in Kansas, the court stated that a breach of a non-compete agreement that occurred after the filing of a bankruptcy was not erased by the bankruptcy. The ruling came from a case between Michael Capps and Cybertron International Inc., in which Capps was claiming that his bankruptcy removed the repercussions of breaching the non-compete when writing it off as a debt claim in his chapter 7 filing. The court ruled against Capps for multiple reasons. The breach of his non-compete occurred after his petition for bankruptcy and, more importantly, the non-compete breach fee is not claimable as a debt in a bankruptcy.

Missouri Man Ordered to Watch Bambi as a Part of His Sentence for Illegally Killing Hundreds of Deer

Deer poacher David Berry Jr. has been ordered to watch the Walt Disney movie Bambi at least once a month as a part of his year-long jail sentence. He was convicted of illegally killing wildlife and a firearms probation violation.

Attorney Gets Prison Time for Bankruptcy Fraud

Attorney Scott Maasen has been sentenced to 18 months in prison and ordered to pay $1.4 million in restitution in a bankruptcy fraud case. He filed for bankruptcy in 2009 after he stopped making payments on a $1.5 million loan. Maasen purchased a $90,000 engagement ring for his fiance while proceedings were pending by using a credit card and bank account in his fathers name. Scott Maasen

He has previously pleaded guilty to one count of concealment of assets in bankruptcy.

Using Credit Cards to Pay for Your Bankruptcy

Although you may want to do so, you cannot use a credit card to file for bankruptcy.  The bankruptcy courts do not allow you to put the cost of your bankruptcy on credit.  However, you can always use a debit card, check, cash, or money order to pay for your bankruptcy.
