After Toys R’ Us filed for bankruptcy a few weeks ago, many toy makers are feeling their financial woes. Many toymakers are owed lots of money from Toys R’ Us but may not receive everything that they are entitled to. In addition, toymakers are not seeing the orders from the toy store giant that they once experienced.

Another Wells Fargo Settlement

Wells Fargo will be paying customers that were charged “rate-lock extension” fees when attempting to obtain a mortgage.  The total settlement payout is around $98,000,000 and will be paid to approximately 110,000 borrowers.

Burn It Down

Growth is usually followed by decay; life is followed by death, and here is another case where fire follows construction. Some Taxpayers have donated their house to the fire department so that the fire department can practice their skills and burn the house down. These taxpayers have then claimed a deduction that is hotly contested by the IRS if all the following haven’t been followed.

Donate the house and the land to the fire department. This is best done by deeding the entire property over to the fire department.

Do not replace the home or have already slated it for demolition. Replacing the house disallows any charitable deduction being taken.

But, if done correctly, you can get a huge tax deduction in the amount of the fair market value of the house and land. Something to think about.

Pension Plans are Going Broke

The Washington Examiner has estimated that 114 multi-employer pension plans, involving 1.3 million people, are underfunded.  This means that the amount of money in the pension plan is less than the amount that the plan should have.

Property the Bankrupt Court Cannot Take

State law dictates that certain property, protected by state law, cannot be touched by the federal bankruptcy court in Missouri or Kansas.  This stays true, even when protected property is converted into property that the bankruptcy could have otherwise taken.  This was true in the Hawk case in Kansas when a protected IRA retirement account was converted into a non-protected asset.

According to the Lee’s Summit Tribune, 27 year old Tracy Ford pled guilty to having over 2,300 copies of counterfeit Missouri driver’s licenses and counterfeit hardware.
