Cannot Appeal a Motion for Summary Judgment

Missouri courts have stated that a court’s decision regarding a motion for summary judgment, whether it is denied or approved, is not appealable.  Since they are not appealable, it is important to respond to a motion for summary judgment as best as possible in order to protect yourself.

Appealing Your Court Decision

In Missouri, you have ten (10) days from when a judgment becomes final in order to file an appeal with an Missouri appellate court. Usually a judgment becomes final within thirty (30) days from when the Judge issues their order. Unfortunately, Missouri appellate courts are not forgiving in this rule. If you are late by one day, the Missouri appellate courts will deny your appeal. Who Files What in Appellate Court?

If you had a case decided by a judge or jury and you are unhappy with the outcome, then you would need to file a notice of appeal with the Missouri Court of Appeals. However, if your case involves the review of an agency’s decision, then whoever lost at the agency level files the notice of appeal. Please keep in mind that failure to file a timely notice of appeal and brief can result in dismissal. If you are filing an appeal, contact us at 816-524-4949.

Appealing your Divorce

When a Judgment is Not Final

A motion to compel settlement is not a final, appealable, judgment until the underlying action as to all claims and parties has been disposed. A judgment granting a motion to enforce settlement is not ready for appellate review until the underlying action has terminated. Appeal from Summary Judgment Discussed

On appeal from summary judgment, rule requires “specific page references to the relevant portion of the record on appeal, i.e., legal file, transcript, or exhibits” that established the material facts. “[N]or can we determine which material facts, if any, pled by [such movements] were properly denied by [appellant’s] response[s].”
