Bankruptcy and Malpractice Claims

A legal malpractice claim is when you believe your attorney messed up in some way, costing you money.  If you file bankruptcy and have a malpractice claim, the bankruptcy trustee can pursue the claim on your behalf in order to pay some of your creditors.  However, in order to be part of your bankruptcy, you must have been aware that you had a malpractice claim before you filed for bankruptcy.
