Motions to Re-Consider

While the Missouri Rules of Civil Procedure do not provide for a motion for reconsideration, the court often treats the motion as a motion for a new trial.  However, a Missouri court recently ruled that a motion to reconsider filed three (3) years after the case was closed was too late.

Dinging Your Credit Score

– Over $34,000,000,000 was spent in 2013 on renovations and repairs.

– 80% of renovations are paid for by cash/savings, 22% use credit cards, and 15% use a bank loan.

– After the renovation was complete, 38% of people go over budget.

– The top four upgrades with the best payoff are the front door, stone veneers, garage doors, and wood decks.

– Kitchen remodels generally take 8.3 months to complete, but bedroom remodels generally take 6.7 months.

– The average cost of a kitchen remodel in New York City is $24,881, but in Houston it is $17,951.

What to do When You Get a Letter from the IRS

Here are some tips to consider if you get a letter from the Internal Revenue Service:

  1. Don’t panic. Our law office is here to assist you.
  2. Read the letter. The letter often explains what the issue is.
  3. Respond to the letter. If you disagree with what the letter claims, you must respond to the letter. Failure to respond may result in the IRS assuming that you agree with them.
  4. Keep a copy of the letter. You may need to refer to the letter at a later time.
  5. Make sure it is a letter. The IRS will always notify you of a problem by letter. The IRS will not call you or e-mail you.  If you receive a phone call or e-mail from the IRS, it is probably a scam.

Silly State Laws

To get you scratching your head, here are a few silly state laws for your entertainment:

– Newlyweds in the U.S. Virgin Islands, after getting married, must go promptly to the court clerk so that the wife can change her last name to her husband’s.  The law requires the wife to change her name.

– Alabama’s constitution still requires that public schools be segregated, separating the white children from the colored children.

– In Michigan, it is a crime for a man and a woman to live together.  Anyone convicted of this crime can be jailed for up to one year and fined up to $1,000.

– A person cannot buy the following items in New Jersey on a Sunday:  alcohol, clothing, furniture, home furnishings, and appliances.

Receiving Unsolicited Faxes

Businesses who send faxes to people who did not request them or who did not authorize them can be held liable for violating the Telephone Consumer Protection Act.  Recently, in New Jersey, a commercial roofing company was fined $22 million in a class action lawsuit against them for sending unwanted faxes.

Act Fast When Suing for Fraud

How Does Your Credit Score Rank?

According to Money.com, the average credit score in the United States is a little bit below 750.  If your credit score is not up to par, here are a few things you can do to increase your score:

  1. Dispute anything on your credit report that you believe is incorrect.
  2. Do not max out your credit availability.
  3. Never make a late payment.
  4. Always pay as much as you can towards the balance.

Terminating Parental Rights in Missouri

Missouri allows the termination of parental rights when there is a legal basis and it would be in the best interests of the child.  A parent, who is given a list of items to correct by the state, can lose their parental rights if they fail to correct the items listed by the state.  Some examples of items that the state may want corrected are drug problems, missed visits with the child, failure to change a bad lifestyle, or criminal activity.
