In order to modify a child support order, a person must show a 20% change on Form 14 and that there has been a substantial and continuing change in circumstances. Construction May Not Be Tax-Exempt

A Missouri construction company was not allowed to make tax-exempt purchases of materials for concrete walls that they used on construction sites. The Missouri Supreme Court has ruled that in order to make tax-exempt purchases, the materials purchased must be used to manufacture another item, and that item must be marketed or made for sale. Had the construction company marketed the concrete walls, the purchase of the materials would have been tax-exempt. Suing Your Own Company

Setting Aside a Missouri Default Judgment

Gay Parental Rights in Oklahoma

The Oklahoma courts have ruled that a same-sex parent, who was not the parent who actually had the child but did assist in raising the child, did not actually have any standing or rights to see the child.  Oklahoma states that in order to have a legally protected interest for parentage, meaning to be able to have custody or visitation with the child, a person must be the mother of the child, the man whose paternity of the child is to be adjudicated, or a representative authorized by law.  Without a parenting plan or arrangement, the same-sex parent who was not the biological parent is not allowed any parenting time, visitation, or any custody.  If you are in need of a parenting plan or arrangement, contact our office at 816-524-4949.

Bankruptcy and Divorce

In a Chapter 7 bankruptcy, domestic support obligations, under 11 U.S.C. 523(a)(5), and non-domestic support obligations, under 11 U.S.C. 523(a)(15) are not dischargeable.  This means that they do not go away when a person files for bankruptcy. A domestic support obligation means child support, alimony, or maintenance that is owed.  Non-domestic support obligations are debts that arose from family law proceedings, such as attorney fees, the division of property, or other debts owed to the former spouse.

In a Chapter 13 bankruptcy, only domestic support obligations, under 11 U.S.C. 523(a)(5), are not dischargeable.  This means that a Chapter 13 debtor could erase debts that are non-domestic support obligations.

Domestic support obligations could be child support, maintenance, alimony, guardian ad litem fees, psychologist expenses, attorney fees related to a custody case, or any other items the parties meant to be in the nature of support for a child or the former spouse.
