Eviction Moratorium To End This Week

The Federal Eviction Moratorium that was put in place for tenants in late March, has come to an end. With moratorium expiring, landlords are given the greenlight to proceed with action for their delinquent tenants. This means, the property-owners are required to give notice of 30 days and then carry on with the filing of eviction paperwork. Not only is   the moratorium ending, the enhanced unemployment benefits are also coming to an end putting pressure on those who were just barely making it already.

Experts say, this will one of the hardest setbacks to come back from all due to the pandemic. Senator, Kamala Harris of California, revealed a proposal that would ban evictions and foreclosures up to a year. This gives the tenants up to a year and a half to pay back any missed payments. However, a system passed by the House called, The Emergency Rental Assistance Program is designed to support renters at the lowest income levels for up to 2 years.

Popular Music Festival Co-Founder Expects No Concerts Until 2022

The well-known music festival co-founder, Marc Geiger, says he thinks there may not be any concerts or festivals until 2022, due to the coronavirus. While believes, the concerts and festivals would not due well with the status of the economy. He also adds, the insurance for these productions would be a “hassle” or” too complicated” to apply and would be harder for the majority of promoters to achieve.

American Airlines Furlough 25,000 Employees

With some states experiencing another rapid increase in COVID-19 cases, American Airlines notify their frontline workers of possible layoffs. According to The Worker Adjusting and Notification Act, the employers are required to notify employees of possible lay offs at least 60 days before.

The potential layoffs are expected to be 2,500 pilots, 10,000 flight attendants, and 3,200 mechanics. A spokesperson for the company says, this is affiliated with the overstaffing it expects to have in the fall when the government assistance the airline has been receiving expires. Chie Executive Doug Parker and President Isom say they hope to reduce the potential layoffs through increased leave or early departure programs they have since instilled.

Recently, the deadline for the Paycheck Protection Program was extended by the signing of a bill by the President. Due to numbers not adding up, as far as those who qualify for the PPP loan, some have yet to apple according to reports made last week. The prompted the President to extend through August 8th. This loan is for businesses to take care of payroll, rent, hold the company over for at least 2 months and if 60% is used, the loan will be forgiven. The programs promoter say that the objective is to help those small businesses who are affected by the pandemic and those who will be in the next several months if not already.

After receiving criticism, the Senator of Florida, Marco Rubio assures the intent is for more help for the small businesses and especially for those in our inadequately serviced communities.

Documents from Bankruptcy Court in Wilmington, Delaware show the owner of the Los Angeles franchise owes lenders $182 million and owes his merchandise vendors $79 million. An underdog company, SPARC Group LLC, from the director of Aeropostale has inquired about buying the investment. The requirements for a bid are $140.1 million in cash and a credit bid of $51.5 million by its lenders.

The co-owners of the SPARC group are Authentic Brands Group LLC and Simon Property Group who are masterminds behind the strategy to bid for the sinking company. With plans to team up and take over the troubling store, the two owners previously bought Forever 21 who also recently filed for bankruptcy.

CFPB Sues Timemark Inc. Plus its Owners

A Florida based company, Timemark Inc., have come to a settlement with The Consumer Financial Protection Bureau. Timemark, its owners and its officers are being accused of charging illegal advance fees to buyers who are looking to renegotiate, settle, reduce, or alter the terms of their loans by CFPB. This is a violation of the Telemarketing Sales Rule (TSR).

A complaint from CFPB, that was filed in the federal district court for the Southern District of Florida stated from 2016- through October 2019, Timemark was essentially using sales campaigns to recruit 7300 customers to pay over $600 in fees to file paperwork to get their monthly payments for their federal student loans, loan consolidation, forgiveness, or income based repayment plans, condensed or removed. However, through The US Department of Education, those debt-relief services are free to student loan borrowers.

Furthermore, the violation of TSR accusations made by CFPB allege the company violated the rule because they requested and received payments from customers who accepted the offers from the campaigns.

Former Prosecutor May Face Charges

A former prosecutor, Jeanne Lippert, from Erie County may be facing charges after her bankruptcy case was reopened. Jeanne filed for Chapter 7 bankruptcy in January of this year. The federal government wants to reopen because of accusations of “false oaths and concealments.” Two weeks prior, Lippert was fired for pending criminal proceeding and for filing for unemployment benefits while still employed at the prosecutor’s office.

Two weeks later, a motion was filed by an attorney with the US Trustee’s office to reopen the bankruptcy case after learning about the “flaws” of the filing. However, a specific motion was filed by the US Department of Justice attorney Derrick Rippy and US Trustee Andrew Vara with claims of the following:

  • Jeanne wrongly said she did not own any property
  • Jeanne was receiving income from a part-time job but did not reveal that in bankruptcy filing
  • Jeanne listed her residence as being bigger than it truly is
  • Falsely claimed she lived separate from her husband Chief Bob Lippert of Huron – also did not reveal his income

Jeanne received a grant of discharge for the debt which mean no action can be taken from anyone on the debt per court documents. Though, the US Trustee’s office is trying to revoke the discharge. The judge who is handling the case is Judge Gustafson and as of currently, there are no rulings on the US Trustee’s motion.

Mexico’s second largest airline, Grupo Aeromexico SAB, has filed for bankruptcy. While there has been a sharp decrease in travel, the company is using this time to refinance. The impact has been so significant that the airline was forced to cut costs as much as $50 million monthly, as well as forcing unpaid leave for employees. Unlike their counterpart partners in Europe and the US, the airline has received little help from the government, if any at all. The region’s carrier is looking at the domino affect of its carriers dropping due to the Covid-19 impact.

In order to reform their finances, Old Time Pottery has decided to file for bankruptcy this week due to impact of Covid-19. Prior to the pandemic, the company experienced a sudden decline in sales that went on as long as 6 weeks. According to the company’s statement, the were mandated to follow the regulations of the state and local governments. This meant the closure of stores in the states of North Carolina, South Carolina, and Illinois. However, they did not see any reductions in staffing in any other stores or distribution centers outside of these states.
