Individuals with Significant Tax Debt Should Act Promptly to Avoid Revocation of Passports

Under the Fixing America’s Surface Transportation Act, the Internal Revenue Service notifies a State Department of taxpayers certified as owing a seriously delinquent tax debt, which is currently $52,000 and above. The law then requires a State Department to deny their passport application or renewal.  A State Department may revoke a passport or limit a taxpayer’s ability to travel outside the U.S.

Certain Summer Activities Can Affect Next Year’s Tax Returns

Summertime activities, such as getting married, sending kids to summer day camp, and working part time, often affect the tax returns filed the following year. Newlyweds should report name and address changes to the Social Security Administration. The cost of summer day camp may count towards the child and dependent care credit. Bankruptcy Attorney Sanctioned for Filing Bankruptcy Petitions and Pleadings Without “Wet Ink” Signatures

In 32 bankruptcy cases, Lawrence Willis was retained as bankruptcy counsel by various debtors. In connection with his legal representation, and prior to filing each case with the Court, Willis received an advanced expense retainer of $500 from each client. Despite receiving the $500 retainers, Willis caused the 32 cases to be filed without payment of the requisite filing fees. Instead, Willis filed motions requesting that his clients be permitted to pay the filing fees over time because they were unable to pay upfront. Willis admitted that none of his clients saw or signed the motions.

Off-The-Clock Injury Was Work-Related

In the workplace, ownership and control of premises determines relation to work, which does not exclude events off the clock, and claimant was on her way to clock in. An employer’s slippery floor was not “a hazard or risk unrelated to the employment to which workers would have been equally exposed outside of and unrelated to the employment in normal non-employment life.” The slippery floor was not excluded from coverage.

No Misconduct Shown

Laws allow denial of employment benefits for misconduct in the workplace, which includes knowing violation of employer policies and common standards of behavior. Gossip may be included, which the employer charged, and the Labor and Industrial Relations Commission found, but those findings do not stand on competent and substantial evidence. There was nothing presented that would have determined that supervisory figures in the workplace are a protected class.

Exploitation Conviction Affirmed

“An appellate court does not engage in a weight-of-the-evidence review in a criminal case,” only a review of whether the evidence was sufficient to convince a reasonable juror of defendant’s guilt. A finding of guilty was supported in the defendant’s associate’s testimony, who confessed to tricking the victim out of money.
