One Spouse Cannot Transfer Entire Property Without the Other Spouse

In a recent action to quiet title, on a motion for summary judgment, respondent established that they had purchased title from a married couple and that appellant’s deed of trust came from only one spouse. Neither spouse has any interest that they convey alone because property acquired by a married couple is presumed to be held by the entirety. Appellant’s deed of trust did not support an equitable lien because it was not from both spouses.

Bankruptcy Attorney Sanctioned for Filing Bankruptcy Petitions and Pleadings Without “Wet Ink” Signatures

In 32 bankruptcy cases, Lawrence Willis was retained as bankruptcy counsel by various debtors. In connection with his legal representation, and prior to filing each case with the Court, Willis received an advanced expense retainer of $500 from each client. Despite receiving the $500 retainers, Willis caused the 32 cases to be filed without payment of the requisite filing fees. Instead, Willis filed motions requesting that his clients be permitted to pay the filing fees over time because they were unable to pay upfront. Willis admitted that none of his clients saw or signed the motions.
