No Right to Counsel During a DUI

A Kansas court has ruled that a person does not have the right to ask for counsel when being tested for a DUI. However, after the DUI test, the court has ruled that a person can ask for legal representation. When a person asks for legal counsel, law enforcement must allow the person to contact an attorney for representation.
