How to Draft a Motion for Summary Judgment

The Missouri Court of Appeals ruled in a recent decision that if you file a motion for summary judgment with the court, and the motion does not have numbered paragraphs, then the motion is not valid.  A motion for summary judgment must flow, as a matter of law, from appropriate numbered paragraphs.

Settling Your Debts

Although it is not as fast as bankruptcy, debt settlement can provide a wonderful route for consumers to get rid of their debt without having to pay their creditors in full and avoiding the bankruptcy court.  Debt settlement is when a consumer stops paying a creditor in order to try and force the creditor to make a settlement offer.  If the consumer has the funds to pay the creditor what they are wanting, the consumer can potentially save money by not paying the creditor in full.  However, debt settlement can be complicated and should not be done without legal counsel.

Photos are Safe in Bankruptcy

In a recent Kansas bankruptcy case, a bankruptcy trustee tried to liquidate the digital photos of a photographer who filed for bankruptcy.  The photographer attempted to save the photos under the Kansas tools-of-trade exemption.  The exemption allows a debtor to save up to $7,500 in property used by the debtor for their profession or occupation.  The bankruptcy court ruled in favor of the photographer, and the photos were safe from liquidation.
