Medical Music

musicIn 1962, the IRS allowed a taxpayer to deduct the cost of his son’s clarinet lessons because the lessons were recommended by the son’s orthodontist in order to fix the son’s overbite.  This ruling stems from lobbying orthodontists that argued that playing the clarinet helps with a child’s overbite and therefore should qualify as a medical expense.

The IRS allowed the taxpayer to deduct the cost of the clarinet as well as the cost of the music lessons.  But just remember, since it qualifies as a medical expense, it is subject to the same 10% limitation that all other medical expenses are subject to.

  1. Make sure you choose the right business structure. An LLC is often not the best structure to choose. If you need help setting up your business and choosing the right structure, be sure to contact our office.
  2. Be aware of the four (4) types of common business taxes: income taxes, self-employment taxes, employment taxes, and excise taxes. You also should be aware of estimated tax payments and the IRS’ EFTPS system.
  3. You will need to obtain an Employer Identification Number (EIN) for your business. This is essentially the Social Security Number for your business.
  4. Choose the correct accounting method. Most businesses fall under the cash accounting method. However, the IRS requires businesses in certain industries to use the accrual method or other accounting methods.
  5. Determine if you are subject to the Affordable Care Act. Usually businesses are exempt from the new Obamacare laws if they have less than fifty (50) employees.

Taxpayer Bill of Rights

taxpayer

The IRS has issued bill of rights that every taxpayer has, and some of them are:

  1. You have the right to receive a tax notice informing you of the tax, interest, and penalties that the IRS claims you owe.
  2. If the IRS denies a part of your refund, it must notify you, in writing, of why it did so.
  3. If you enter into a payment plan with the IRS, the IRS must send you an annual statement telling you how much you still owe.
