Resisting Arrest – A Felony or a Misdemeanor?

resisting arrest

A recent Missouri court determined that there are varying degrees of a resisting arrest charge. In order for a resisting arrest charge to be considered a felony, Missouri must provide evidence that the arrest was for a felony charge. Without establishing a felony charge, it is considered a misdemeanor. If you have recently been charged with a crime, contact our office at 816-524-4949 or check out our website at Hoorfarlaw.com.

Scandal at the Waffle House

waffle house 3

Two Georgia lawyers, David Cohen and John Butters, were recently charged with conspiracy to commit extortion, conspiracy to commit illegal eavesdropping and surveillance, and unlawful eavesdropping or surveillance after using a secret sex tape from their client to extort money from the CEO of the Waffle House, Joe Rogers. The CEO’s former housekeeper used the sex tape to obtain a $12 million settlement in order to keep the scandal out of the public eye. After countering for a mere $100,000, Rogers sued housekeeper, and her lawyers, for invasion of privacy and unjust enrichment. Rogers claims the sexual encounters were consensual and the unauthorized tape was merely being used for “sextortion.” If you are in legal trouble, contact our office at 816-524-4949 or check out our website at Hoorfarlaw.com.

My Child Support is How Much?!

child support 4

When a maintenance or child support obligation is made, the court must look at all of the financial resources of the party. Once your monthly payment is established, you might think you’re forever stuck with that number. However, statute requires “current financial resources of the parties” to be examined. This allows for payments to be decreased, or potentially increase, if there is found to be significant changes in the party’s finances. If you are having difficulty making maintenance or child support payments, contact our office at 816-524-4949 or check out our website at Hoorfarlaw.com.

Possession Needed for Arrest

drug possession

Under accomplice liability in Missouri, the law does not allow possession of pseudoephedrine with the intent to use it in making methamphetamine. It was recently found, however, that a person must be in possession of the pseudoephedrine at the time of the arrest in order to satisfy the essential elements of the crime. If you have recently been charged with a drug related crime, contact our office at 816-524-4949 or check out our website at Hoorfarlaw.com.

Excuse me, have you been drinking this evening?

dui check point

Regardless of whether or not a glass of your adult beverage of choice was had at dinner, pulling up to a DUI checkpoint can be stressful. There are several things to know before driving through in order to make sure your rights are being protected. First, all DUI checkpoints must be established by supervisory personnel and given adequate procedure – meaning officers cannot set up checkpoints based on their own discretion. Next, the stops must be standardized and cannot be made randomly. The checkpoint should also display adequate safety precautions such as proper lighting, warning signs, and signals. In the state of Missouri, however, finding that a checkpoint did not give officers any discretion was enough to establish that the checkpoint was valid. If you have been charged with driving under the influence, contact our office at 816-524-4949 or check out our website at Hoorfarlaw.com.

Hulk Hogan Forces Bankruptcy

Financial struggles aren’t avoided the more money an individual or company has. Recently, Gawker Media, an online media company with assets around $50 to $100 million, has recently filed for Chapter 11 bankruptcy while appealing a $140 milling verdict for Hulk Hogan. Chapter 11 bankruptcy is available for troubled businesses and gives them the ability to restructure their debts with the hopes to become financially stable again. Luckily for Gawker, all litigation is halted during a Chapter 11 bankruptcy which means the company doesn’t need to currently deal with the $140 million verdict against them. Surprises in Your Car

road trip 2

It’s officially road trip season and it’s common to allow your friend or significant other to take the wheel for a while so you can have a break from driving. Unfortunately for one Missouri driver, after being pulled over, one man was arrested for not only driving on a suspended license but also for the meth found in a subsequent search of his girlfriend’s car. Luckily, the Missouri courts determined that a person who drives a vehicle with the owner’s permission has the same expectation of privacy when it comes to a search and seizure as the actual owner of the vehicle. The evidence was excluded from court due to lack of reasonable suspicion, but it’s always best to make sure there are no dead bodies hiding out in the trunk of your friends car the next time you grab the wheel. If you have recently been arrested or are dealing with a drug charge, contact our office at 816-524-4949 or check out our website at Hoorfarlaw.com.

Tax Break for College Students

college students

College students are always looking to save money in any way they can, especially when it comes to taxes. Fortunately for them, Uncle Sam gives them two potential credits, the American Opportunity Credit and the Lifetime Learning Credit, in order to help manage sometimes outrageous tuition and educational expenses. Most often these credits are based on the amount shown on your Form 1098-T, however, it was recently found that these credits are based on the amount you paid during the year, not what was billed. Make sure you keep track of all tuition and required course materials you purchased and paid for during the tax year in order to get the full credit you deserve. If you need help with your taxes, contact our office at 816-524-4949 or check out our website at Hoorfarlaw.com.
